Please read these terms carefully before using EscrowZW services. These terms govern your use of our web and mobile applications.

By accessing or using the EscrowZW platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you must discontinue use of our services immediately.

1. Service Description

EscrowZW is a secure escrow payment platform engineered for Zimbabwe. We facilitate trusted transactions between buyers and sellers by holding funds safely until goods or services are delivered.

• Buyers create escrow deals and pay funds via Paynow integrals (EcoCash, OneMoney, Zimswitch, InnBucks, O'mari).
• Sellers are notified that funds are secured and fulfill the order.
• Funds are released to the seller once the buyer confirms receipt of the goods or services.

2. Account Registration & Responsibilities

To use our services, you must register for an account using a valid email address and secure password. Upon registration, you are issued a unique Account Number (e.g., ES-XXXXXXXXXX) which governs your transactions.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access or use of your account.

3. Fees and Charges

EscrowZW charges a flat platform fee on successfully completed transactions to maintain operations and security.

• Platform Fee: The platform deducts a 2.0% fee from the total transaction amount before disbursing funds to the seller.
• Payment Gateway Fees: Any standard transactional fees imposed by mobile money operators (EcoCash, Paynow, etc.) during funding or withdrawal are the responsibility of the user as determined by the payment provider.

4. Dispute Resolution

In the event of a disagreement between a buyer and a seller, either party may initiate a Dispute within the platform. Once disputed, funds are frozen.

Users agree to attempt to resolve the issue directly first. If unsuccessful, the dispute will be escalated to the EscrowZW administrative team. The EscrowZW team will review evidence (receipts, delivery notes, communications) requested from both parties and make a final, binding determination regarding the disbursement of funds.

If the EscrowZW mediation team fails to resolve the dispute to the satisfaction of the parties, an escalation to legal officers or courts of competent jurisdiction may be opened. Please note that all legal costs and associated expenses will be the sole responsibility of the involved parties, not EscrowZW.

5. Limitation of Liability

While EscrowZW endeavors to provide a highly secure and reliable service, we cannot guarantee uninterrupted access or absolute protection from all security threats.

EscrowZW, its directors, and employees shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the platform, including but not limited to reliance by a user on any information obtained from EscrowZW.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms and Conditions (e.g., fraudulent behavior, money laundering attempts, selling illegal items).

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Zimbabwe, without regard to its conflict of law provisions.
